RIDER TO TAS RELEASE AND WAIVER OF LIABILITY FOR TRIPS
INVOLVING PREPAYMENTS FOR GOODS AND SERVICES
The undersigned (hereinafter called “Participant”) shall bear all economic loss associated with the trip which Participant shall incur. No such loss shall be borne by the the Taos Archaeological Society, by the trip organizer (hereinafter called “Wrangler”) or by any other member of the Society.
If Participant cancels his/her trip after making any prepayments respecting the trip, the Wrangler shall make a reasonable effort to mitigate the loss to Participant by returning any undisbursed and uncommitted funds of Participant and by seeking a trip replacement for Participant, but if no replacement is found Participant shall only be entitled to those refunds of his/her prepayments which are allowed by any service provider to whom such prepayments have been committed. Such refunds would include, in the case of Participant having agreed to share a hotel room or other expense with another trip participant, the excess of the amount payable for a single room or other expense for which a single supplement is imposed over the portion which such other trip participant would have paid of the cost of a double room or other expense shared with Participant, if any, but only if a change of reservation or other expense could be arranged with the hotel or other service provider concerned.
If any service provider to whom a prepayment has been made shall default in its obligation to provide any prearranged service or goods, the resulting loss shall be borne by the trip participants, including Participant, in accordance with the contributions of each. Any unforeseen expense, such as damage to a rental car (excepting gross negligence of the driver in cases where such degree of negligence may be determined), shall be borne equally by all trip participants, including Participant.
Participant shall be responsible for obtaining his/her own trip cancellation insurance, should such be desired. Participant shall be responsible for determining and obtaining his/her own appropriate clothing, footwear, headgear, food and drink, insect repellant and sunblock, medical supplies and pharmaceuticals for the trip, and also for such pre-trip vaccinations and medications as may he/she may determine to be advisable for travelers to the trip’s destinations.
If for any reason the trip is cancelled after any prepayment has been made to a service provider who refuses to allow a full refund, including a trip cancellation due to the cancellation of several participants thereby making it uneconomical for the non-cancelling participants to make the trip (as determined by a majority of themselves), the loss shall be borne entirely by all the trip participants, including Participant, who shall have contributed to the prepayments, in accordance with the contributions of each.
Participant shall be responsible for arranging any special goods or services he/she may require over and above that provided all participants, including, for example, additional transportation, side trips, shipping of purchased items, special meals for diet or religious reasons, excess luggage, and problems arising from injury, illness, theft, or loss of passport or other papers.
